Is ex CJI Gogoi facing demonization because he has irked the "Lobby"?
Enough is Enough, now high time to deal with "Lobby" of 5-6 advocates of supreme court, trying to armtwist /black mail Supreme Court Judges, in order to force them do, what they want.
Ex CJI Ranjan Gogoi in his recent interview with TOI & Times Now has referred to a "lobby".Same "lobby" of 5-6 SC advocates, earlier eulogized ex CJI Ranjan Gogoi, when he addressed the press conference along with three other senior most SC Judges, because that embarrassed the then CJI Deepak Mishra, who probably wasn't deciding the cases/marking the cases to the SC Judges, to the liking of the " lobby". In fact, as the lobby apprehended Modi govt might go vindictive and may overrule " seniority " criteria while appointing next CJI and Ranjan Gogoi mayn't be next CJI, they started lobbying for appointment of Ranjan Gogoi through their favorite journalists, electronic media and opposition leaders. However to the "glee" of lobby, Modi Govt, instead of getting vindictive, stuck to seniority criteria and Ranjan Gogoi was appointed as CJI . Initially lobby thought, Ranjan Gogoi to their liking would start punishing Modi Govt through his orders;however same didn't happen. Ranjan Gogoi as CJI conducted himself as CJI in a fair & impartial manner and treated/ decided the cases on the basis of "merit" instead of any alleged bias for or against Modi Govt. Rafael case was a political case and after several hearings in the case and based on hearing of defence experts, statement of concerned senior IAF /defence ministry officials, no irregularity, as alleged by petitioners, were found and based on the same, order in Rafael case went in favour of Modi Govt to severe discomfiture of lobby. Even review in the case was dismissed. Again, lobby wanted ayodhya case to be postponed indefinitely but Ranjan Gogoi, refused to oblige lobby and heard the case within a stipulated deadline and six decades old Ayodhya case attained finality through SC order before his retirement. It is interesting to note that Ranjan Gogoi alone didn't pass order in favour of Mandir but order by five judges ( including a Judge from minority community) was unanimous in favour of Mandir. So, how ex CJI Gogoi can be attributed any motive in ayodhya case, when all five judges gave an unanimous order in favour of Mandir?
For, the above reason only, the lobby got hugely incensed against ex CJI because he remained impartial , refused to oblige them and same has possibly irked the lobby. And, the outpouring of venom against ex CJI Ranjan Gogoi over his appointment as Rajya Sabha member is result of their above-said pent up anger. Point is, what is illegality about appointment of an ex CJI as member of parliament. Ex SC Judges, Justice Bahrul Islam & Rang nath Mishra too became members of parliament during Cong Govt in past but no hue cry was made. None alleged quid pro quo against them. Also for an ex CJI, position of Rajya Sabha is not that great. In fact, becoming chairman of some commission might have been more cushy job for the ex CJI. However, if he has chosen to be Rajya Sabha member and be in public life and serve the society in some way, why should others make a hue and cry and question his intent? If all through his judicial career, he was appreciated for being dry honest, a judge of high integrity, how and why all of a sudden after becoming CJI and thereafter his integrity is being questioned? Is he currently being publicly "demonized" because he refused to comply to the wishes of the "lobby"?
